Terms of Service
Effective
These Terms of Service ("Terms") govern your use of HoloRemedi ("the Service"), operated by Holograph PressWorks LLC, a Delaware limited liability company ("we", "us", "our"). By creating an account or using the Service you agree to them.
HoloRemedi is in beta. Beta status sets out what that means for availability, pricing and your data, and it is the section to read first.
1. Beta status
The Service is offered in beta. Concretely:
- Features may change, be withdrawn, or behave differently between releases.
- We aim for continuous availability but do not offer an uptime commitment or service-level agreement during beta.
- Output requires your review. See AI-generated content.
- We may contact you about faults, changes and feedback at the address on your account.
Nothing in this section limits the rights you have under consumer law where you live.
2. Eligibility and accounts
- You must be 18 or older and able to enter a binding contract.
- You are responsible for the accuracy of your account details and for everything done under your account.
- Authentication is handled by Microsoft Entra External ID. Keep your credentials secure and tell us promptly at connect@holographpressworks.com if you believe your account has been accessed by someone else.
- One person or organisation per account unless you are using the team features, where each member signs in with their own identity.
3. What the Service does
HoloRemedi imports an EPUB, audits it against EPUB Accessibility 1.1, WCAG 2.2 AA and EPUBCheck, applies deterministic repairs, generates alt text for images that need it, and returns a remediated EPUB with a conformance report.
The Service currently accepts EPUB only. PDF remediation is in development and is not part of the Service today; nothing in these Terms should be read as a commitment to deliver it on any date.
We do not warrant that remediated output satisfies any particular legal obligation, including the European Accessibility Act, Section 508 or the ADA. Conformance is a property of the finished file as you publish it, and you remain responsible for that file.
4. Availability and changes to the Service
We may add, change or withdraw features, and we may change how the Service works. Where a change materially reduces functionality you rely on, we will give at least 30 days’ notice by email to the address on your account, and you may close your account and receive a refund of unused purchased credit.
We may suspend the Service, in whole or in part, for maintenance, in response to a security incident, or where the law requires it. We will give notice where we can and keep the suspension as short as we reasonably can.
We do not offer an uptime commitment or service-level agreement. Beta status explains why, and what we do commit to.
5. Your content
You keep every intellectual property right in the files you upload. You grant us a limited, non-exclusive licence to store, process and transform them solely to provide the Service to you. That licence ends when the content is deleted.
- We do not use your content to train, fine-tune or evaluate any model, ours or anyone else’s, and we never will under these Terms.
- Our AI provider does not either. Microsoft states that prompts and completions sent to Azure OpenAI are not available to OpenAI and are not used to train Microsoft or third-party foundation models. The one retention path that does exist — abuse monitoring — is described in the Privacy Policy rather than omitted.
- We do not sell, license or disclose your content, except to the processors listed in the Privacy Policy and where the law requires it.
- We claim no ownership of your content and no right to reuse it. Nothing in these Terms transfers copyright, grants a publishing right, or permits us to use your work as a sample, a case study or a demonstration without your written agreement.
- Alt text generated for your images is yours, on the same terms as the rest of the book. We assert no rights over it.
- You confirm you hold the rights needed to upload each file and to have it processed.
Deletion, retention periods and the processors involved are described in the Privacy Policy, which forms part of these Terms.
6. Confidentiality
An unpublished manuscript is the most sensitive thing a publisher hands a vendor, and an embargo is commercially enforced rather than merely preferred. This section exists so that the duty sits in the contract, not only in the Privacy Policy — which governs personal data, and a manuscript mostly is not personal data.
Confidential Information means non-public information one party discloses to the other that is marked confidential, or that a reasonable person would understand to be confidential from its nature or the circumstances. Your manuscripts and the material you upload are your Confidential Information whether or not they are marked.
Each party will:
- use the other’s Confidential Information only to provide or receive the Service;
- protect it with at least the care it applies to its own confidential information, and never less than reasonable care; and
- disclose it only to personnel and processors who need it for that purpose and who are bound by confidentiality obligations at least as protective as these. The processors are listed in the Privacy Policy.
These obligations do not apply to information that is or becomes public without a breach of this section, was already known to the receiving party without a duty of confidence, is independently developed without use of the other’s Confidential Information, or is lawfully received from a third party free to disclose it.
If we are compelled by law to disclose your Confidential Information, we will tell you first wherever we are lawfully able to, so that you can seek protection.
These obligations continue for three years after the Service ends and, for anything that qualifies as a trade secret, for as long as the law protects it.
7. AI-generated content
Alt text and other descriptive text are produced by machine learning models. They are drafts.
- AI output can be wrong, incomplete, or confidently misleading, and an image whose meaning depends on context is where it is least reliable.
- Every generated description is editable in the Service before export, and you are expected to review them.
- You are responsible for the accuracy of the descriptions in anything you publish.
- Where a book already contains human-written descriptions, we preserve them rather than replacing them.
Alt text is generated using Azure OpenAI, a Microsoft service. The Privacy Policy sets out exactly what is sent to it and what is not.
8. Pricing and payment
The Service is pay-as-you-go against a credit balance. Rates at the self-serve tier, read from the same configuration that does the billing:
| Item | Rate |
|---|---|
| Per page of EPUB content | $0.50 |
| Per image requiring generated alt text | $1 |
| EPUB 2 upgrade, per page | $0.50 |
Cover, half-title, title-page, decorative and duplicate images are not charged. Pages are counted from the page-list navigation where present, otherwise from the spine or a word-count estimate.
Credit packs:
| Pack | You pay | Credit received |
|---|---|---|
| Basic | $500 | $550 (10% bonus) |
| Advanced | $2,000 | $2,400 (20% bonus) |
| Enterprise | By agreement | Volume rates — contact us |
New accounts receive $250 in trial credit on first sign-in, which covers roughly one full-length book. Trial credit is not redeemable for cash and is not refundable.
Payments are processed by Stripe, Inc. We never receive or store your card number. Tax is calculated at checkout and shown before you pay.
These rates are read from the billing configuration itself rather than copied into this document, so they cannot drift apart. You are charged the amount quoted before a job runs; if it ever differs from that quote, the billing is the error — tell us and we will correct it and refund the difference.
9. Refunds and service remedies
Purchased credit:
- Unused credit bought in the last 30 days is refundable in full on written request to connect@holographpressworks.com.
- After 30 days, unused credit stays in your account and does not expire, but is no longer refundable for cash.
Individual jobs: if a job returns an empty or unusable file, fails because of our infrastructure, or produces materially incomplete output because of a defect in the Service, email us the project ID and we will return the full job cost to your credit balance, normally within five business days.
We do not refund jobs that produced valid output containing AI imperfections you would be expected to catch in review, jobs run on files outside the documented format or size limits, or jobs already exported and accepted.
We may change prices with at least 30 days’ notice by email. Credit already purchased keeps the value it had when you bought it.
10. Acceptable use
You may not use the Service to:
- Process content you have no right to process.
- Upload malware, or files crafted to attack the Service or other users.
- Attempt to access another account, or any system or data that is not yours.
- Circumvent metering, credit limits, rate limits or access controls.
- Resell the Service as your own without a written agreement with us.
- Process content that is unlawful where you or we operate.
We may suspend an account that is causing harm to the Service or to others, and will tell you why.
11. Export controls and sanctions
The Service is provided from the United States and is subject to United States export control and sanctions law. You represent that you are not, and are not acting on behalf of, a person who is:
- located in, ordinarily resident in, or organised under the laws of a country or region subject to comprehensive United States sanctions;
- identified on the United States Treasury’s Specially Designated Nationals and Blocked Persons list, the Commerce Department’s Denied Persons or Entity List, or an equivalent list maintained by the United Nations, the European Union or the United Kingdom; or
- otherwise barred from receiving services of United States origin.
You will not use the Service, or permit it to be used, in breach of those laws, and you will not make output available to anyone you could not lawfully supply directly.
12. Disclaimers
Except as these Terms state and as your local law requires, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that any output will meet a specific accessibility standard or satisfy a specific legal duty.
13. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
Our total liability arising from the Service is limited to the greater of the amount you paid us in the three months before the claim arose, or $100.
That cap does not apply to either party’s obligations under Indemnities, to a breach of Confidentiality, or to your obligation to pay amounts due. A cap that swallowed the indemnities would leave them doing nothing.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
14. Indemnities
Why this is here: every file this Service processes is a book, and we have no way to verify who owns one. Your content has you confirm that you hold the rights. This section says what happens if that turns out to be untrue — the cost of being wrong is not ours to carry.
You indemnify us. You will defend, indemnify and hold harmless Holograph PressWorks LLC and its members, officers, employees and contractors against any third-party claim, demand or proceeding, and any resulting loss, damage, settlement, fine or expense including reasonable legal fees, arising from:
- content you upload or instruct us to process, including any allegation that it infringes or misappropriates a copyright, trademark, trade secret, moral right, right of publicity or other right;
- your breach of these Terms, including the confirmation in Your content that you hold the rights needed to upload each file; or
- your unlawful use of the Service.
We indemnify you. We will defend, indemnify and hold you harmless against any third-party claim alleging that the Service itself, used as we document it, infringes a copyright, trademark, patent or trade secret. This does not cover a claim arising from your content, from your combination of the Service with anything we did not supply, from your use of the Service after we have told you to stop, or from a modification you made.
If the Service becomes, or we believe it may become, the subject of such a claim, we may at our own cost procure the right to continue, modify it so that it is non-infringing, or terminate the affected part and refund unused purchased credit.
How a claim is handled, both ways. The party seeking indemnity will tell the other promptly in writing, give it sole control of the defence and settlement with counsel of its choice, and co-operate at the indemnifying party’s expense. A delay in notice reduces the obligation only to the extent it causes prejudice. Neither party may settle a claim in a way that imposes a payment, an obligation or an admission of fault on the other without that party’s written consent.
The limit in Limitation of liability does not cap either indemnity in this section.
15. Termination
You may close your account at any time from account settings, which deletes your account and associated content as described in the Privacy Policy.
We may suspend or close an account for a material breach of these Terms, for unlawful use, or if we stop offering the Service. Where we close an account for reasons other than your breach, we will refund unused purchased credit.
Export your files before closing your account. Deletion is not reversible.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from them.
If you are a consumer resident elsewhere, none of that takes away the protection of the mandatory consumer law of your place of residence, and you may bring proceedings in your local courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before formal proceedings, please contact us at connect@holographpressworks.com: most disputes are a misunderstanding about a specific job and are resolved in a day.
17. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days’ notice by email to the address on your account and update the date at the top of this page. Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not, close your account and we will refund unused purchased credit.
